Wedding Terms - Charlene Reed Photography

WEDDING TERMS & CONDITIONS

Photographer

Charlene Reed Photography will be the exclusive photographer retained to photograph the Wedding day. Wedding attendees will be allowed to photograph the wedding so long as they do not interfere with the Photographer or take pictures where the photographer has arranged or positioned the subject(s) of the photo. In the extremely unlikely event that the photographer is ill or for other reasons cannot perform its obligations under this Agreement, then the photographer will make reasonable efforts to procure a substitute photographer. Charlene Reed Photography shall not be liable for failure to perform due to acts of God or other reasons out of the control of the photographer. If Charlene Reed Photography cannot perform the duties for any reason, then Charlene Reed Photography will return any amounts paid by Client unless such failure to perform was due to the actions or inactions of Client.

The hours contracted include shooting the wedding and travel. Charlene Reed Photography shall have no obligation to stay and/or take any photos beyond this time period.

Food

Charlene Reed Photography does not insist that the photographers are fed with the wedding party however if not, please be aware that the photographers may go off site to eat during the wedding breakfast if so and therefore cannot guarantee that special parts will be covered during this time.

Payment & Cancellation

The total amount due for the wedding is due no later than 4 weeks before the date contracted. Client shall pay a non-refundable retainer of 10% for the photography services. Charlene Reed Photography will not refund the retainer or any other amounts paid should Client cancel for any reason unless cancelled within 14 days of booking. Charlene Reed Photography will not refund the retainer or any other amounts paid should Client change dates. Charlene Reed Photography may, at our, discretion, allow Client to apply any or all of the amounts paid to the new date. Such change shall require an amendment to this Agreement reflecting the new date and changes in fees (if any). If Charlene Reed Photography already has a booking for the new date, another photographer may be sent working on behalf of Charlene Reed Photography.

Proofs and Selection of Photos

Proofs will be available to view via a password protected album on the website for the Client within 12 weeks of the wedding. The wedding guests can also see these with permission from the happy couple, where they will also be able to order any prints they might want based on Charlene Reed Photography’s current price list.

CHARLENE REED PHOTOGRAPHY MAKES NO GUARANTEE OF AVAILABILITY OF YOUR PHOTOGRAPHS BEYOND THE ONE YEAR PERIOD.

Ownership and Use Restrictions

Copyright to the photographs and digital files taken as a part of the Services is and shall remain exclusively with Charlene Reed photography who shall have the exclusive right to make reproductions of the photographs and/or digital files unless such right is specifically granted to Client. The photographs are for the clients personal use only and the client shall not sell, reproduce or authorise reproductions unless specifically agreed to by Charlene Reed Photography in writing. If the client is specifically obtaining a photograph for publicising the wedding in an announcement, newspaper or other media, then the client is authorised to use the photograph with credit to Charlene Reed Photography. The client may post photographs to social networking or other web sites at the client’s discretion so long as such posting does not violate any terms of this Agreement. It is a violation of copyright law to allow photographs taken by Charlene Reed Photography to be reproduced or altered in any manner not specifically allowed under this Agreement.

Charlene Reed Photography’s rights to the photographs include, without limitation, the right to use the photographs for advertising or other purposes. This may include posting of the photographs on Charlene Reed Photography’s web sites, social media pages and on line albums. If you do not want your photographs published or displayed publicly, other than in Charlene Reed Photography’s online photo gallery, please express this in a private message.

Warranty and Limitation of Liability

All Services shall be performed in a professional manner, consistent with industry standards. Charlene Reed Photography will make efforts to take all requested photos but the client is aware that weather, availability of photo subjects, lighting and other factors may not allow for certain photos to be taken at all or in the manner anticipated. Charlene Reed Photography may be limited by restrictions put upon the photographer by the venue or official conducting the Wedding. Charlene Reed Photography is not responsible for the actions of the wedding party or guests and their possible interference with the photographers obligations. The client fully understands the foregoing and specifically agrees that Charlene Reed Photography will have no liability for claims based on the foregoing.

Complaints

Any complaints must be put in writing, either by email or letter within 7 days of viewing the images. Charlene Reed Photography will do the best possible chance to correct any complaint and any proceedings shall be between the client and Charlene Reed Photography via written correspondence.

Raw Files

Charlene Reed Photography will take a large number of images. Post production the photographer will cull images to an amount the client will be satisfied to view. Any raw files remaining will be stored on an external hard drive for 18 months before deletion. No raw files will be given as this is not of the artistic and creative final product of Charlene Reed photography. The client cannot obtain raw files for their own keeping to edit or adjust the images the photographer has taken. Each raw file and jpeg is copyrighted to Charlene Reed Photography. Jpeg files are edited and provided to the client only.

IN NO EVENT SHALL CHARLENE REED PHOTOGRAPHY BE LIABLE FOR ANY AMOUNTS IN EXCESS OF THE TOTAL AMOUNT ACTUALLY PAID BY CLIENT AND RECEIVED BY PHOTOGRAPHER FOR THE SERVICES.
